Important Updates from HMRC for EU Settlement Scheme (EUSS) Holders

If you hold status under the EU Settlement Scheme (EUSS), it’s important to keep your UK immigration status up to date. Here’s a quick guide to ensure smooth travel and avoid issues with your UKVI account. 

 

Why Should You Update Your UKVI Account? 

  • Traveling soon? If your details aren’t up to date, you may face delays or even be denied boarding when traveling to or from the UK. 
  • Pre-settled status holders: If your identity document has changed, you could encounter problems when applying for settled status. 
  • Keeping your UKVI account updated will help ensure you’re not caught off guard, especially when new checks are introduced next year. 

 

What You Need to Do: 

  • Got a new passport or ID? Make sure your UKVI account reflects your new details. 
  • Planning to travel? Double-check that the passport number, expiry date, and nationality match the details in your UKVI account. 
  • Applying for settled status? If your passport or ID has changed, update your UKVI account before submitting your application. 

 

Simplified Rules for Settled Status 

The Home Office has simplified the rules for those with pre-settled status. You can now apply for settled status if: 

  • You’ve lived in the UK for at least 30 months in the 5 years before you apply. 
  • You arrived in the UK at least 5 years ago. 

No need to provide explanations for time spent outside the UK, as long as you meet the 30-month residency rule. 

Important: If you’ve been outside the UK for more than 2 years before May 2024, your pre-settled status may have lapsed.  

 

Who Will Get Settled Status Automatically? 

From 2026, the Home Office will automatically upgrade pre-settled status to settled status for those who meet specific criteria, such as 5 years of UK residence with minimal absences 

If eligible, you’ll be contacted directly by the Home Office. 

 

Who Still Needs to Apply for Settled Status? 

You’ll need to apply for settled status if: 

  • You haven’t paid UK tax or received benefits for at least 30 months in the last 5 years. 
  • You’re a family member who isn’t from the EEA or Switzerland. 
  • You’re a family member who started living in the UK after 31 December 2020. 
  • You’re under 18 years old. 
  • You have other eligibility requirements (e.g., derivative rights).
